Terms of Service.

The following terminology applies to this Terms and Conditions, Privacy Statement and Disclaimer Notice, and any or all Agreements: “You” and “Your” refers to you, the person accessing this website and accepting Tupelo and Honey LLCs Terms and Conditions.  “The Company”, “Ourselves”, “We” and “Us”, refers to our Company Tupelo and Honey LLC.  “Party”, “Parties”, or “Us”, refers to both the Client and ourselves, or either the Client or ourselves.  Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same. 

In using this website You are deemed to have read and agreed to the following Terms and Conditions, which may be updated or changed from time to time by Tupelo and Honey LLC without notice to You.  If You do not agree with any of the Terms and Conditions, do not use this website, our mobile app, or our services. Because our services are evolving over time, We may change or discontinue all or any part of our services, at any time and without notice, at our sole discretion. Your continued use of this website following the posting of any changes to this Terms and Conditions constitutes acceptance of those changes.

Booking
Fill out our inquiry form for the picnic or event with your preferred date/time. Within 24-48 hours, we will confirm availability and send you your invoice along with a link to review our Terms and Conditions. Due to high demand and limited date availability, we require payment in full for any picnic or event, unless you were sent the option for a 50% non-refundable deposit. Please remit payment when you receive your invoice by the due date. If payment is not received, your booking is not secured and your reservation cancelled.

Add-ons and Upgrades
We offer many upgrades and add-ons to our current package offerings. Please make these selections at the time of your original booking. However, you can make additional add-ons, changes, and upgrades up to 7 days before your booking date, subject to availability.

Cancellations
- Cancellations made more than 21 days before the event* will receive a full refund less a $50 cancellation fee.
-Cancellations (that do not fall under our inclement weather policy) made at-least 7-days prior to the event* will receive a 50% refund.
-Any cancellation made less than 7-days before the event*, NO refund will be processed.
(*Exact day measured from the start time of your event. For example, if the event begins at 3 pm on a Friday, you must cancel before 3 pm on the previous Friday to receive a 50% refund).

Rescheduled Events or Picnics
A guest may reschedule 7 days or more prior to their event and have 100% of their original booking fee applied to a new date. The rescheduled event must occur within 180 days of the original date.

If the guest chooses additional add-ons or upgrades for their rescheduled event, the guest is responsible for the balance and must be paid upon rebooking.

Inclement Weather
Due to the nature of Virginia weather, our main venue options are indoor or covered outdoor spaces. If weather permits on the day of the event or picnic, the picnic can be set up on an adjacent lawn area (following all venue guidelines). This allows for Tupelo and Honey LLC to continue to serve Southwest Virginia, rain or shine.

If our guests select a venue that does not have an alternative indoor or suitable in climate weather option, the guests assumes risk with this booking. Guests will not be refunded their booking fee; however 50% of their booking fee can be applied to a future reservation within 60 days. Tupelo and Honey LLC reserves the right to not set up a picnic in inclement weather.

We will not set up a picnic or event outside in inclement weather, exposed to the elements.

Lost, Stolen, or Damaged Items
Our coordinators will remain at the picnic site until you arrive and transfer oversight of the picnic to you or your representative (e.g. a photographer) and have the final waiver signed on-site.

Please notify us 30 minutes in advance if you plan to leave early. We ask that you stay near your picnic area until our team arrives since you will be responsible to cover all fees for any damaged/stolen items during the entire duration of your reserved picnic time slot.

If there is an urgent matter and you need to abruptly end your picnic, please contact your coordinator immediately and dial 9-1-1 for any emergencies.

Guests agree to exercise all due care in caring for, and preserving the property of Tupelo and Honey LLC inventory. Guests will remain responsible for all loss or damage to inventory, up to and including actual replacement value for each missing or damaged item. Please see our COST OF GOODS sheet. Fees will apply for replacement at the full cost of purchasing a replacement. The cost to replace items that have been lost, stolen, or damaged will be charged to the credit card on file.

All Equipment supplied on hire is the property of Tupelo and Honey LLC.

Any damage, loss or extensive cleaning will result in a fee to The Customer.

Our furniture is very delicate. It requires special handling from our team. The persons hosting the event shall be responsible for any loss or damage to any items such as plates, goblets, ceramic bowls/plates, vases, props and other decorations.

The Customer shall pay for all equipment damage or loss however caused during that period. Damage includes but is not limited to;

  • Improper use of equipment

  • Disappearance of the equipment

  • Damage to, or loss of, the equipment from any unknown cause

  • Cigarette burns on any furniture or décor items. Smoking is not permitted on or near the property of Tupelo and Honey LLC

  • Red wine or other staining product spillages or stains on any furniture or décor items

With the exception of battery-powered candles, no candles, fires or other flammable properties are to be lit during the booking. 

Pets
We LOVE pets, but they are not invited to our picnics or events.

Alcohol Consumption
It is the responsibility of the customer to check alcohol laws of any venue or public space being used for our pop-up picnics. Most public parks are prohibited from drinking and a fine can be issued. Tupelo and Honey LLC takes no responsibility for any alcohol consumption or penalties.

Food Consumption
We are not responsible for any food allergies or any issues or illness caused from foods that were consumed or purchased from third party vendors.

Image Release

In the event that photographs of Your Picnic Package have been taken and shared either on social media or with Us, Tupelo and Honey LLC reserves the right to use such photographs in its promotional materials. 

Liability
Tupelo and Honey LLC shall in no way be held responsible or accountable for any damage, injury, illness, death or loss of income caused to the client, any third parties or properties due to the hire of equipment or provided services by the hire company. All equipment is hired and is the responsibility of the client until returned to the hire company.

Force Majeure
Tupelo and Honey LLC shall not be liable for any failure or delay in delivery or otherwise performing its obligations hereunder with respect to any goods or services being purchased if such failure or delay is caused by a strike, lockout, labor dispute, accident, war, act of terrorism, act of God, fire, flood, or other casualty or cause beyond Tupelo and Honey LLCs  reasonable control.ent until returned to the hire company.

FAQs

  • Fill out our inquiry form and our coordinator will be in touch within 24-48 hours.

  • We will make an effort to provide you with all of the details of your confirmed location prior to your event date for you to plan your travel time accordingly.

    However, we will allow a 15 minute grace period and cannot extend your end time because of your late arrival. Our team will return promptly to clean up and break down at your arranged end time.

  • You will have the option to add additional time in advance at $30/each additional 30 minutes and $60/each additional hour at the time of booking. You may also request additional time up to 7 days before your event, subject to availability.
